Lawsuit Against PERA and the State Update

DENVER - Stephen Pincus, the attorney representing ‘Save PERA COLA’ and handling the lawsuit against PERA and the State of Colorado, provided an update Friday on the legal action.

“The defendants are scheduled to file a response to the lawsuit by May 8,” he said. “We’ll have a better idea of the defendants’ position when we receive their response.”

According to Pincus, the case has been assigned to Chief Judge Robert S. Hyatt of the 2nd Judicial Division of the state district court. The Judge’s biography is available at: http://www.courts.state.co.us/Bio.cfm/Employee_ID/551   

The case had originally been assigned to Chief Judge Larry Naves; however, he is retiring this month. The case is #2010-CV-1589 in Denver's District Court.

Rich Allen and Gary Justus, who are spearheading the ‘Save PERA COLA’ effort are planning a meeting in the Denver area for mid-May at a time and place to be determined to devise strategies to further the publicity of Save PERA COLA, sign up volunteers and discuss Senate Bill 1, the lawsuit, and its effects on retirees.
